California Jury Awards $2 million for a Wrongful Death Caused by a Dangerous Intersection
According to the Sierra Star, a Madera County Superior Court jury has awarded the record sum of $2 million to the family of a Livingston woman who died in a motorcycle accident caused by a dangerous road intersection in Madera County.
The jury found that the July 5th, 2008 motorcycle crash at the intersection of Highway 41 and Road 416 in Madera County resulted from the negligence of the California Department of Transportation (Caltrans). The jury agreed with the plaintiff’s argument that the State of California was aware of a lengthy history of “broadside” accidents at this intersection, yet had failed to make any recommended safety improvements.
The 31-year-old victim of the California motorcycle accident was riding as a passenger with her husband, who survived the bike wreck. They were southbound on Highway 41 when a Coarsegold resident in a vehicle pulling a trailer entered the roadway in a “blind spot” ahead of the motorcycle on a downhill grade. Although the motorcycle braked, it struck the vehicle broadside.
A worrisome pattern of accidents
Although previously warned about the pattern of local accidents, Caltrans and other authorities had not taken any steps to correct the negligent conditions which ultimately led to the wrongful death of this hapless biker. The jury likewise found the driver of the vehicle partially responsible for the accident, while the motorcyclists were blameless.
